The U.S. Department of Health & Human Services defined the national standards in the Standards for Privacy of Individually Identifiable Health Information ("Privacy Rule"). The Privacy Rule extended the requirements within the Health Insurance Portability and Accountability Act of 1996 ("HIPAA").

“Individually identifiable health information” includes demographic data; past, present, or future physical or mental health conditions; the type of service or care provided; the past, present, or future payment for the provision of health care,; and any other information that might reasonably identify the patient/individual.
